When you purchase MyBatteryKit, you receive a limited, non-exclusive, non-transferable license to use the software according to the purchased plan and device or seat limits defined at the time of purchase.
You may not resell, sublicense, reverse engineer for redistribution, abuse the licensing system, or use the service in a way that disrupts the website, payment flow, licensing service, or support operations.
Prices, discounts, taxes, and campaign periods may change at any time before purchase. The final charge is the amount displayed in Stripe Checkout at the time of payment.
We may update, improve, or discontinue features at any time. Some features depend on macOS capabilities, third-party services, or supported hardware and may vary by device or OS version.
MyBatteryKit includes features that may affect charging behavior, power-related automation, sleep behavior, and other battery-management settings on supported Macs. Those features should be used carefully and only on hardware and macOS versions you believe are compatible.
You are responsible for reviewing feature descriptions, following on-screen warnings, maintaining backups, and stopping use if you notice overheating, unstable behavior, unexpected charging behavior, or any other issue affecting your Mac, battery, data, or workflow.
Except where prohibited by law, you assume the risks inherent in using optional hardware-control and automation features. Nothing in these terms limits any non-waivable consumer rights or liability that cannot be excluded under applicable law.
MyBatteryKit is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data loss, goodwill, business interruption, or damage to devices, batteries, peripherals, or other property arising from or related to use of the software or website.
To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to MyBatteryKit, the website, or any purchase will not exceed the amount you paid for the applicable product or plan during the 12 months before the event giving rise to the claim, or if the claim relates to a one-time lifetime purchase, the amount you paid for that purchase.
Nothing in these terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot be excluded, or any other rights that cannot be waived under applicable law.
